The Hampton
The RainmakerThe Hampton is the decaying brick apartment building where Rudy Baylor has lived for almost three years. His second-floor, two-room efficiency costs $275 a month, a rent he seldom pays on time. The building’s worn condition and the strain of keeping a home there make it both a place of shelter and a measure of how unstable his circumstances have become.
Setting and Tenants
A block from a busy street and about a mile from campus, The Hampton is populated by students and other financially struggling residents. Its landlord is accustomed to bargaining over overdue rent, an established pattern that has allowed Rudy to remain there despite his arrears. He has recently imagined leaving in the middle of the night and negotiating payments later; until his job disappears, however, that plan assumes he will still have a paycheck.
Summons in the Parking Lot
Just before two in the morning, Rudy parks near the Dumpster and encounters a process server in the dark parking lot. The man serves him papers for both Texaco’s lawsuit and The Hampton’s eviction proceedings. Rudy is told that the documents contain the court date and lawyers’ names, and that he may be able to resolve the matters with a few phone calls. As the process server leaves, he adds that police are looking for Rudy in connection with damage to a downtown law office and advises him to find somewhere else to sleep. The building’s lot thus becomes the setting where Rudy’s housing crisis meets the immediate possibility of arrest.
Eviction and Temporary Protection
The eviction threat remains active the next day, when Rudy goes to bankruptcy court. Filing his own Chapter 7 petition invokes the Bankruptcy Code’s automatic stay: his landlord cannot evict him that day or even call to berate him. The stay offers immediate legal protection, not a resolution of his unpaid rent. The Hampton consequently marks the narrow line between temporary security and exposure to loss of housing—a line Rudy can hold only by using the law while facing insolvency.
